BuyingSeller TermsGeneralPrivacy Policy

OpenBinder is a website where individuals list cards from their personal Magic: The Gathering collections for sale. It's run by an individual in Nova Scotia, Canada (the "site owner"). By using OpenBinder, placing an order, or opening a collection, you agree to these terms.

1. Who you're buying from

Each collection belongs to its own seller. When you order, your purchase is directly between you and that seller. OpenBinder doesn't own, hold, inspect, ship or get paid for any cards, and isn't a party to the sale. The seller's name and e-Transfer email are shown on the collection and your order page.

2. Buying

Personal sales, no tax

Sellers are individuals selling personal items, not businesses, so no GST/HST or PST is charged. Prices are in Canadian dollars.

Orders and payment

  • Placing an order is an offer to buy the listed cards at the listed prices, plus the shipping shown at checkout. The minimum order is C$20 in cards.
  • Pay by Interac e-Transfer only, to the seller's email shown on your order, with your order code in the message, within 48 hours. Your cards are held for you until then; after that the order is cancelled automatically and the cards go back on sale.
  • Your order is accepted once the seller confirms your payment. Never send payment anywhere other than the email shown on your order page.
  • Prices are set by each seller (usually from TCGplayer market prices) and can change. The price you pay is the one shown when you ordered.

What you get

  • Each listing is a specific printing: set, card number, finish (e.g. foil, Surge Foil, etched), frame and language. Pictures show that printing (images courtesy of Scryfall); they are not photos of the exact copy.
  • Cards are Near Mint unless the listing says otherwise (Lightly Played, Moderately Played, Heavily Played or Damaged).
  • Sellers may only list genuine cards. Proxies, counterfeits and altered cards aren't allowed.

Problems, returns and refunds

  • All sales are final, except when a card doesn't match its listing: wrong card, printing, finish or language, clearly worse condition than listed, or not genuine.
  • If that happens, email the seller within 7 days of receiving your order (reply to your order email, or use the seller's email on your order page). The seller will refund that card when you return it, or agree on a partial refund. Counterfeit cards are refunded in full.
  • If a seller cancels an order you've paid for, they'll refund your e-Transfer within 3 business days.

Shipping and pickup

  • Shipping is within Canada only, by Canada Post. Delivery times are Canada Post's estimates and aren't guaranteed.
  • Lettermail (not tracked) is cheaper but can't be traced. By choosing it, you accept the risk of loss once the seller has mailed it.
  • Tracked shipping is the seller's responsibility until Canada Post shows it as delivered. If a tracked parcel is lost, the seller will refund or replace it, and handle any claim with Canada Post.
  • Pickup is arranged by email after payment. Meet somewhere public. Cards picked up are accepted as seen.

3. Seller Terms

If you open a collection on OpenBinder, you also agree to the following:

  • Personal collection. You're selling your own cards as an individual. If your selling becomes a business, you're responsible for registering it and for any GST/HST, income tax and other obligations that come with that.
  • Accurate listings. Only list genuine cards you actually have, in the condition stated. Remove or hide cards you've sold elsewhere.
  • Honour orders. Sell at the price shown when the buyer ordered. Mark payments promptly, ship within 3 business days of payment (or arrange pickup), and use the shipping method the buyer paid for.
  • Refunds. Handle problems under section 2 in good faith, and refund within 3 business days when you cancel a paid order.
  • Buyer information. Use buyers' names, emails, phone numbers and addresses only to complete their order. Don't add them to mailing lists, share them or keep them longer than you need to.
  • Payment safety. Only treat an order as paid once the money is in your bank account. Fake "e-Transfer received" emails are a common scam.
  • Tax information (CRA reporting). Under Canada's reporting rules for digital platforms (Part XX of the Income Tax Act), the site owner may have to report sellers who make 30 or more sales, or more than C$2,800 in sales, in a calendar year through OpenBinder. If you reach either amount, you agree to provide the information the law requires (such as your legal name, address, date of birth and Social Insurance Number) when asked, or to stop accepting orders. Your dashboard shows your sales for the year.
  • No fees. OpenBinder is free and takes no commission. The site owner may hide or remove a collection that breaks these terms or gets complaints.

4. General

Using the site

Don't misuse OpenBinder: no fake orders, fraud, scraping, attempts to break into accounts, or anything illegal. The site owner may cancel orders, block access or remove content to protect buyers and sellers. Keep your seller password private.

Trademarks and card images

Magic: The Gathering, card names, card images and mana symbols are owned by Wizards of the Coast LLC. OpenBinder is unofficial and isn't produced, endorsed, supported or affiliated with Wizards of the Coast. Card data and images are provided by Scryfall, which also doesn't endorse OpenBinder.

No warranties; limits on liability

OpenBinder is provided free and "as is". The site owner doesn't guarantee that it will always be available or error-free, and isn't responsible for sellers' or buyers' actions, lost or delayed mail, or payments sent to the wrong place. To the fullest extent the law allows, the site owner isn't liable for any loss arising from using OpenBinder or from a sale between a buyer and a seller. Nothing in these terms takes away rights you have by law that can't be waived.

Disputes

Please try to sort out problems with the other person first. If you can't, contact the site owner at contom91@gmail.com. The site owner can help but isn't obliged to decide disputes. These terms are governed by the laws of Nova Scotia and the federal laws of Canada that apply there.

Changes

These terms may be updated; the date at the top shows the latest version. Orders are covered by the terms in place when they were placed.
